This site is provided by the International Association of Tao Soul Heart Mind and Body (referred to throughout this site as the Association) as a service to our visitors.

We offer you our greatest love, peace and harmony. The following statements in this Policy may seem quite strong. This policy is necessitated by our operation as an entity in the physical world. Thank you for your understanding.

The Association provides its services to you subject to the following conditions on this page. If you visit or shop at iTaoAssociation.org, you unconditionally accept and are bound by these Conditions of Use. Please read these conditions carefully.

In addition, when you use any current or future Association services or visit or purchase from any business affiliated with the Association, whether or not included in the web site, you will also be subject to the conditions and guidelines applicable to such service or business. INTERNATIONAL ASSOCIATION OF TAO SOUL HEART MIND AND BODY, and other the Association logos, graphics, page headers, scripts, button icons and service names are registered trademarks, trademarks or trade dress of the Association in the United States and/or other countries. Our failure to list a current trademark is not a waiver of our intellectual property rights to that logo, graphic, page header, script, button icon or service name.

The Association’s trademarks and trade dress may not be used in connection with any product or service in any manner that is not the Association’s, in any manner that is likely to cause confusion among customers or in any manner that discredits or disparages the Association. All other trademarks not owned by the Association that appear on this site are the property of their respective owners, who may or may not be sponsored by, affiliated with or connected to the Association.

LICENSE AND SITE ACCESS

The Association grants you a limited license to access and make personal use of this site and not to download, other than page caching, or modify it, or any portion of it, except with express written consent of the Association. This license does not include any downloading or copying of account information for the benefit of another merchant; any commercial use or resale of this site or its contents; any collection and use of any product or service listings, descriptions or prices; any derivative use of this site or its contents; or any use of data mining, robots, or similar data gathering and extraction tools. YOUR ACCOUNT

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. If you use this site, you also agree to accept responsibility for all activities that occur under your account or password. the Association does sell products or services for children; however, it sells them to adults who can purchase them with a credit card. If you are under 18, you may use the Association only with involvement of a parent or guardian. the Association and its affiliates reserve the right to refuse service, terminate accounts, edit or remove content or cancel orders in their sole discretion.

STORIES, COMMENTS, OTHER CONTENT AND COMMUNICATIONS

If you do submit material or post content, and unless we indicate otherwise, you grant the Association and its affiliates a nonexclusive, royalty-free, irrevocable, perpetual and fully sublicensable right to use, publish, modify, adapt, reproduce, distribute, translate, create derivative works from and display such content throughout the world in any media. You grant the Association and its affiliates and sublicensees the right to use the name that you submit in connection with such content if they choose. You represent and warrant that you own or otherwise control all of the rights to the material or content that you submit or post; that the material or content is accurate; that use of the material or content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify the Association or its affiliates for all claims resulting from material or content you supply. the Association has the right but not the obligation to monitor and edit or remove any activity, material or content. the Association takes no responsibility and assumes no liability for any material or content submitted or posted by you or any third party.

In some instances, the content available through the the Association site represents the opinions and judgments of the respective third party providing such content. the Association neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made on the the Association site by anyone other than the Association. Under no circumstances shall the Association or its affiliates, or any of their officers, directors, employees or agents be liable for any loss, damage or harm caused by your reliance on information obtained through the the Association site. It is your responsibility to evaluate the information, opinion, advice or other content available through the the Association site.

RISK OF LOSS

All products or services purchased from the Association are made pursuant to a shipment contract. This means that the risk of loss and title for such products or services pass to you upon our delivery to the carrier.

PRODUCT AND SERVICE DESCRIPTIONS

The Association and its affiliates attempt to be as accurate as possible. However, the Association does not warrant that product or service descriptions or other content of this site are accurate, reliable, current, complete or error-free. If a product offered by the Association itself is not as described, your sole remedy is to return it in an unused, unmarked condition as detailed in our Shipping and Returns Policy. PRICING

Except where noted otherwise, the price displayed for products or services on our site represent the full retail price listed on the product or service itself suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured product or service offered elsewhere. The price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that are offered as a set, the price may represent “open-stock” prices, which means the aggregate of the manufacturer’s estimated or suggested retail price for each of the items included in the set. Prices and availability are subject to change without notice.

With respect to products or services sold by the Association, we cannot confirm the price of a product or service until you order. Despite our best efforts, a small number of the products or services in our site may be mispriced. If we discover a mispricing, we will do one of the following:

  • If a product’s or service’s correct price is lower than our stated price, we will charge the lower amount and ship you the item or deliver it to your soul.
  • If a product’s or service’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or delivering it to your soul or cancel your order and notify you of such cancellation.

All returned checks are subject to a returned check fee of $25.00 CAD.

Credit Card Reversals
Credit card reversals not caused by the Association are subject to a reverse charge fee of $25.00 CAD.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THIS SITE IS PROVIDED BY the Association ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE ASSOCIATION MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS OR SERVICES INCLUDED ON THIS SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, THE ASSOCIATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. the Association DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR EMAIL SENT FROM the Association ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. the Association WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES.

APPLICABLE LAW

By visiting the Association, you agree that the laws of the State of California, United States of America, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and the Association or its affiliates.

DISPUTES

Any dispute relating in any way to your visit to the Association or to products or services you purchase through the Association shall be submitted to confidential arbitration in the State of California, United States of America, except that, to the extent you have in any manner violated or threatened to violate the Association’s intellectual property rights, the Association may seek injunctive or other appropriate relief in any state or federal court in the the State of California, United States of America, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the law of the the State of California, United States of America. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this agreement shall be joined to an arbitration involving any other party subject to this agreement, whether through class arbitration proceedings or otherwise.

INDEMNIFICATION

You agree to defend, indemnify and hold harmless the Association and its affiliates from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site.

SITE POLICIES, MODIFICATION AND SEVERABILITY

Please review our other policies, such as our Privacy Policy and Shipping and Returns Policy, posted on this site. These policies also govern your visit to the Association. We reserve the right to make changes to our site, policies and these Conditions of Use at any time. You should check our site frequently to see any recent changes. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.

GENERAL

This agreement represents the complete agreement between the parties and supersedes all prior agreements and representations between them. Headings used in these Conditions of Use are for reference purposes only and in no way define or limit the scope of the section. The failure of the Association to act with respect to a breach of this agreement by you or others does not constitute a waiver and shall not limit the Association’s rights with respect to such breach or any subsequent breaches.
